PIONEER METROPOLITAN DISTRICT NOS. 1, 2, 3, 4, 5 AND 6

PIONEER REGIONAL METROPOLITAN DISTRICT

As required by Section 32-1-207(3)(c), C.R.S., the following report of the activities of Pioneer Metropolitan District No. 1 (“District No. 1”), Pioneer Metropolitan District No. 2 (“District No. 2”), Pioneer Metropolitan District No. 3 (“District No. 3”), Pioneer Metropolitan District No. 4 (“District No. 4”), Pioneer Metropolitan District No. 5 (“District No. 5”), Pioneer Metropolitan District No. 6 (“District No. 6”), and Pioneer Regional Metropolitan District (“Regional”, and together with District No. 1, District No. 2, District No. 3, District No. 4, District No. 5, and District No. 6, the “Districts”) from January 1, 2024 to December 31, 2024 is hereby submitted.

A.                Boundary changes made:  

The following boundary changes were made in 2024:

·         District No. 1 - Order for Inclusion of approximately .531 acres recorded October 4, 2024 at Weld County Reception No. 4986452.

·         District No. 1 - Order for Inclusion of approximately 132.597 acres recorded October 28, 2024 at Weld County Reception No. 4990928.

·         District No. 2 - Order for Inclusion of approximately .535 acres recorded October 4, 2024 at Weld County Reception No. 4986453.

·         District No. 3 - Order for Inclusion of approximately .538 acres recorded October 4, 2024 at Weld County Reception No. 4986454.

·         District No. 3 - Order for Inclusion of approximately 184.882 acres recorded October 28, 2024 at Weld County Reception No. 4990929.

·         District No. 3 - Order for Inclusion of approximately 686.417 acres recorded October 28, 2024 at Weld County Reception No. 4990930.

·         District No. 4 - Order for Inclusion of approximately .538 acres recorded October 4, 2024 at Weld County Reception No. 4986455.

·         District No. 5 - Order for Inclusion of approximately .578 acres recorded October 4, 2024 at Weld County Reception No. 4986456.

·         Regional - Order for Inclusion of approximately .554 acres recorded October 4, 2024 at Weld County Reception No. 4986457.

·         District No. 6 - Order for Exclusion of approximately 3.845 acres recorded October 7, 2024 at Weld County Reception No. 4986634.

·         District No. 6 - Order for Exclusion of approximately 1.0 acres recorded October 7, 2024 at Weld County Reception No. 4986635.

·         Regional - Order for Exclusion of approximately 1.0 acres recorded October 7, 2024 at Weld County Reception No. 4986636.

B.                 Intergovernmental Agreements entered into or terminated: 

 

·         Capital Pledge Agreements between District No. 3 and each of District No. 2, District No. 4 and District No. 5 were terminated as a result of District No. 3’s repayment of its Limited Tax General Obligation Refunding and Improvement Bonds, Series 2016 to which the Capital Pledge Agreements pertained.

D.                Summary of litigation involving the Districts’ public improvements:

The Districts’ public improvements were not involved in any litigation in 2024.

E.                 Status of the Districts’ construction of public improvements:

The Districts did not construct public improvements during 2024.

F.                  Conveyances or dedications of facilities or improvements, constructed by the Districts, to Weld County:

The Districts did not convey any facilities or improvements to Weld County in 2024.

G.                 Final assessed valuation of the Districts for the report year:

I.                    Audited financial statements for the reporting year (or application for exemption from audit):

Linked below, are the 2024 Audit Exemption Applications for District Nos. 1, 3, 4, 6 and Regional.  Audits for the current report year (2024) are still in process for District Nos. 2 and 5.  Copies of the 2024 Audits will be provided once they are completed. The 2023 Audits for District Nos. 2, 3 and 5 were not completed when the Districts’ 2023 Annual Report was filed but have since been completed.  Copies of the 2023 Audit for District Nos. 2, 3 and 5 are linked below.

J.                   Notice of any uncured events of default by the Districts, which continue beyond a ninety (90) day period, under any debt instrument:

To our knowledge, there are no uncured events of default by the Districts which continue beyond a ninety (90) day period.

K.                Any inability of the Districts to pay their obligations as they come due, in accordance with the terms of such obligations, which continues beyond a ninety (90) day period:

To our knowledge, the Districts have been able to pay their obligations as they come due.
